Torts - also known as quasi-delicts. It is the commission of an act by one without right whereby another receives some injury directly or indirectly in person, property, or reputation. It is likewise defined as a wrong independent of a contract or a breach of duty which the law has distinguished from a contract as imposed. In other words, there is no contract involved or none entered into between the parties.
An example is what happened to Atty. Rene Saguisag yesterday. When the truck hit their car there was tort and damage done. The truck driver did not have the right to cause damage or injury to Saguisag and the other passengers with him. Simple.hehe
Three Elements of Torts (which must concur before tort can arise):
1. There must be a right and a duty;
2. There must be an act or omission;
3. Damage was done.
